How to Remove an Abandoned Car from Private Property in California

Abandoned and inoperable cars take up spaces, collect trash, and attract more problems. Property owners often wait because they're not sure what they're allowed to do. California's Vehicle Code section 22658 gives you three clear paths.

This is general information, not legal advice. Read CVC section 22658 or talk to an attorney about your property.

Option 1: Use your posted signs

If your property has compliant tow-away signs at every entrance, an abandoned vehicle can be removed like any other unauthorized vehicle. Someone authorized by the property signs the tow authorization and is present to verify the violation.

Option 2: The 96-hour rule

If the vehicle was issued a notice of parking violation and 96 hours have passed since it was issued, it can be removed even if the property doesn't have the standard sign.

Option 3: Missing major parts

If the vehicle is missing parts needed to operate safely on the road, such as the engine, transmission, wheels, tires, doors, or windshield, it can be removed once the property has notified the local police and 24 hours have passed.

What happens after the tow

  • The towing company notifies police that the vehicle was removed
  • The registered and legal owners are notified in writing
  • The vehicle is stored within 10 miles of your property
  • If no one claims it, it goes through California's lien sale process

The vehicle's owner pays the towing and storage charges if they claim it.

Tips

  • Photograph the vehicle and note the date you first saw it
  • Check with residents or tenants before towing, in case it belongs to someone who's away
  • Keep a copy of every authorization and notice
