HOA Parking Enforcement in California: A Practical Guide for Boards

Parking disputes are some of the most heated in any homeowners association. Guest spaces used for storage, RVs in common areas, and cars blocking narrow private streets all land on the board's desk. Enforcement works best when it's predictable and follows the law.

This is general information, not legal advice. Your community manager or HOA attorney can confirm the right process for your association.

Start with your governing documents

Parking rules need to be properly adopted under your CC&Rs and operating rules. Make sure the rules say where residents and guests may park, how long, and what isn't allowed, such as inoperable vehicles, RVs, or commercial trucks.

Post compliant signs

California's towing law, Vehicle Code section 22658, applies to associations of common interest developments. Before most tows, the community needs a tow-away sign at every entrance that's at least 17 by 22 inches, with one-inch lettering, listing the local police phone number and the towing company's name and number.

Decide who authorizes tows

The law lets the association, or its employee or agent, authorize tows. In practice, boards usually name the community manager and one or two board members in the towing agreement. For ordinary violations, that person signs a written authorization for each vehicle and must be present to verify the violation.

Fire lanes are different

Many HOA private streets are fire lanes. Vehicles in a fire lane, within 15 feet of a hydrant, or blocking an entrance or exit can be covered by a written general authorization, so the towing company can remove them without a board member present. The towing company has to photograph each violation first.

Enforce consistently

  • Apply the same rule to every resident, including board members
  • Keep records of warnings, authorizations, and complaints
  • Repaint red curbs and fire lanes before they fade
  • Review the rules each year as the community's needs change
