In California, a property owner can have unauthorized vehicles towed, but in most cases only if the right sign is posted first. Vehicle Code section 22658 spells out exactly what that sign has to look like. This guide covers the requirements and the mistakes we see most often.
This is general information, not legal advice. Read CVC section 22658 or talk to an attorney about your property.
What the sign must include
- At least 17 by 22 inches in size
- Lettering at least one inch high
- A statement that public parking is prohibited and that vehicles will be removed at the owner's expense
- The telephone number of the local traffic law enforcement agency
- The name and telephone number of each towing company that has a written towing agreement with the property
The sign may also say that a citation may be issued for the violation.
Where it has to go
The sign has to be displayed in plain view at all entrances to the property. A single sign at the main driveway isn't enough if the property has a second driveway, an alley entrance, or a shared entrance with a neighbor.
When no sign is required
- The lot is improved with a single-family dwelling
- The vehicle was issued a notice of parking violation and 96 hours have passed since it was issued
- The vehicle is missing major parts needed to drive safely, such as the engine, transmission, wheels, tires, doors, or windshield, and the property has notified police and 24 hours have passed
What happens if the sign is wrong
If a property has a vehicle removed without meeting the sign requirement, the owner or person who authorized the tow can be held liable for double the towing and storage charges. Signs are cheap compared to that risk.
Common mistakes
- Signs that still list a former towing company
- Signs smaller than 17 by 22 inches, or with small lettering
- Missing the local police phone number
- No sign at a secondary entrance
- Signs that are faded, damaged, or hidden behind landscaping
