Fire Lane and Hydrant Towing on Private Property in California

Most private property tows in California need a signed authorization from someone at the property, who also has to be present to verify the violation. Fire lanes are different. Because a blocked fire lane is a safety hazard, the law lets properties authorize their towing company in advance for a short list of violations.

This is general information, not legal advice. Read CVC section 22658 or talk to an attorney about your property.

The exception

Under Vehicle Code section 22658(l)(1)(E), a property and its towing company can sign a written agreement granting general authorization to remove vehicles that are:

  • Parked in a fire lane
  • Parked within 15 feet of a fire hydrant
  • Interfering with an entrance to or exit from the property

For every other violation, the general rule still applies: a written authorization for each tow, signed by someone from the property who is present to verify it.

What the towing company has to do

When a vehicle is removed under a general authorization, the towing company has to photograph the violation before removing it and keep those photos. The vehicle's owner gets a copy of the photos at no charge when they claim the vehicle.

Keep your fire lanes clearly marked

A general authorization only works if drivers can tell where the fire lane is. Faded red curbs and missing stencils lead to disputes. Your local fire authority sets the marking standard for fire lanes on private property, and some properties have fire lanes shown on approved site plans.

  • Repaint red curbs before they fade completely
  • Match the wording and spacing your fire authority requires
  • Mark hydrant zones and no-parking areas at driveways
  • Keep landscaping and dumpsters from hiding markings

Fire lanes and HOAs

Narrow private streets in HOA communities and mobile home parks are often fire lanes. Cars parked on them can keep a fire engine from reaching a home. A general authorization plus clear markings is one of the most effective safety steps an association can take.
